Rental Terms and Conditions
The rules for a booking on lafoscabay.com.
These terms apply to any booking made directly on lafoscabay.com. They summarise the rental agreement you sign electronically when making a reservation; in case of discrepancy, the signed contract takes precedence.
1. The landlord
La Fosca Bay, owner of the Dalí and Miró apartments, tourist accommodations registered with the Catalan Tourism Register. Contact: info@lafoscabay.com.
2. The accommodation
The apartment is rented in full, furnished and equipped, for short-term tourist use only (maximum 31 consecutive days). The maximum capacity stated on the property listing includes children and babies; this must not be exceeded. Subletting is prohibited.
3. Booking
You select your dates using the property calendar, complete the booking form and sign the rental agreement online. The booking becomes binding upon payment of the deposit. You will then receive confirmation and the signed contract by email.
4. Prices
The price for your stay is the one displayed at the time of booking, in euros, inclusive of all charges (water, electricity, Wi-Fi, linen). In addition:
- an end-of-stay cleaning fee, indicated prior to booking;
- the Catalan tourist tax, payable by each guest aged 17 and over (capped at 7 nights), collected on site.
5. Payment
A deposit of 30% of the total price is paid online at the time of booking, by credit card (secure Stripe payment) or bank transfer. The balance and cleaning fee are due on the day of arrival, before key handover.
6. Cancellation
By you: the deposit paid is retained by the landlord as a down payment. The balance is not due if you cancel before arrival.
You may however postpone your stay: the deposit remains valid for new dates, subject to availability and at the rate then in force, provided the new stay begins within 12 months of the originally planned arrival date.
By the landlord: unless there is force majeure, the landlord will refund all amounts paid, plus an additional sum equal to the deposit. In case of force majeure, all amounts paid will be fully refunded.
Renting accommodation for a specific date does not entitle you to the 14-day right of withdrawal (art. 103.l of Real Decreto Legislativo 1/2007; art. L221-28 of the French Consumer Code).
7. Arrival and departure
Arrival from 3:00 PM, departure by 10:00 AM. Any arrival after 9:00 PM must be notified in advance.
8. Guest registration
Spanish law (Real Decreto 933/2021) requires the landlord to declare all guests to the authorities. You must provide, no later than arrival, each guest’s details (name, ID document, date of birth, nationality). Failure to do so may result in denied access to the accommodation.
9. Your obligations
You must use the accommodation peacefully, respect the building’s house rules and neighbours, and must not hold parties or cause noise disturbances. You must leave the accommodation in the same condition as received. Report any damage or malfunction immediately. In case of serious breach of neighbourly conduct or exceeding the permitted capacity, the landlord may require occupants to leave immediately without refund (Decret 75/2020 of Catalonia).
10. Landlord’s obligations
The landlord provides a clean, well-maintained and accurately described accommodation, and remains contactable throughout your stay for any requests or issues.
11. Personal data
Your personal data is processed as described in the privacy policy.
12. Applicable law and disputes
These terms are governed by Spanish law, particularly Catalan tourism regulations, without prejudice to mandatory provisions protecting consumers in their country of residence. In case of dispute, an amicable solution shall first be sought; otherwise, the competent court shall be as provided by law.
